The basics of child custody in California

California, like many other states, has a set of laws detailing the rules of child custody. In California, the California Family Code says that the court may issue an order that "it seems necessary or appropriate" (Section 3022) regarding a child who is still a minor during a divorce or after.

The court, when decisions are governed by several basic legal principles. First, the court must keep in mind the child's welfare as their main securityconcern. The main objective of the court is to ensure the child's health, safety and welfare. This policy is a fellow of the California legislature to find that child abuse and domestic violence are harmful to children.

The court also supposed to try to ensure that children have frequent and continuing contact with both parents. This policy may be abandoned, however, seeing a parent would be detrimental to the child's safety and welfare.

By assigning custody,the court has several options on the type of custody. There are three main types of custody arrangements, all subsets; orders Sole custody, joint custody orders, and orders are not their relatives custody.

Orders sole custody may be sole legal or physical. Orders to give sole custody to one parent. That a parent given primary physical control of the child and the right and responsibility to make legal decisions regarding the child's residence, health, education, andwelfare. The visitation of the noncustodial parent are secondary and are ordered by the court.

Sole physical custody gives one parent physical sole custody of the child without the legal part. The child lives with and is supervised by a parent, but parents are not only given the power of decision with respect to other matters affecting the child.

Legal custody gives a parent the exclusive right and responsibility to make decisions about a childhealth, welfare and education, however, that the parent has physical custody of the child.

Joint custody orders may be purely joint joint legal and joint physical. Pure joint custody orders given either parent sole custody or entity. Both parents have the authority to control and supervise their children. In addition, the physical presence of the child is shared.

Joint legal custody gives both parents the right and responsibility to make decisions aboutchild health, education and welfare. One parent is usually given physical custody of the child.

Physical custody gives each parent "significant periods" of physical custody. Despite the name, when the child can not be divided equally with each parent.

Custody orders are not their relatives are not given lightly. Child custody is given to a person who is given the sole responsibility of their care and control. Parents, the best have beenreasonable visitation rights.

Carlsbad, California Struggles With Car Accidents Involving Pedestrians

A vacation destination and popular seaside resort, Carlsbad in San Diego County, California has had to struggle with making itself more pedestrian friendly to reduce car accidents.

Car collision statistics compiled by the California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS) revealed that in 2006, 21 pedestrians were injured in car accidents in Carlsbad. In addition, one person was killed and 33 were injured in bicycle accidents. Car crashes killed eight and injured 517. Alcohol-related accidents were responsible for five fatalities and 64 injuries. And motorcycle accidents injured 34.

Pedestrian vs. car collisions are becoming more common as people jog and bicycle throughout seaside communities like Carlsbad. In a recent meeting on the City of Carlsbad's Pedestrian Master Plan, the following traffic conditions and recommendations were noted to help reduce car accidents:

Madison Street and Roosevelt Street are too wide. Traffic calming is needed to reduce speeds.
Carlsbad Boulevard is very unsafe and not traversable on foot because of high vehicle speeds.
The intersections of Laguna Drive & Madison Street and Laguna Drive & Roosevelt Street are not safe for crossing.
There is a lack of traffic control on Carlsbad Boulevard between Pine Avenue and Tamarack Avenue.
The Carlsbad Village Road/I-5 off ramps are dangerous, since motorists don't look before turning off the freeway.
Cars are too close to the dirt walking areas along Carlsbad Boulevard, south of Cannon Road and north of Tamarack Avenue, which presents a dangerous pedestrian environment.
A signalized pedestrian crosswalk is needed on Carlsbad Boulevard between Tamarack Avenue and Pine Avenue.
A pedestrian crossing is needed between Tamarack Avenue and Pine Street along Carlsbad Boulevard. The pedestrian crossing should be lit so motorists can see pedestrians at night.
Pacific Coast Highway south of Avenida Encinas is a problem area. Angled parking, high-speed traffic, and no sidewalks, cause pedestrians to walk in the bike lane.
A pathway is needed between Laguna Drive and the City of Oceanside (Eaton Street). Children cross there regularly.
A four-way stop controlled intersection is needed at Buena Vista Circle and Laguna Drive.
A Chestnut Avenue pedestrian crossing is needed to get past the railroad tracks.

Pedestrians in general don't do well in car collisions as the following statistics would suggest:

A pedestrian is killed in the U.S. every 99 minutes.
600 pedestrian fatalities and 13,000 injuries occur every year in California.
28 percent of California's pedestrian deaths occur in San Diego County.
Only half of the pedestrians struck by a motor vehicle going 30 mph survive, and just 15 percent survive if the vehicle is traveling at 40 mph.

California workers' compensation laws place strict time limits and other requirements on injured workers when it comes to reporting a work injury. Failure by an injured worker to follow these rules can result in their forfeiture of an otherwise valid worker's compensation claim.

Be careful, a tactic used commonly by employers in an attempt to avoid having to deal with workers' compensation claims is to lay off the worker, claiming a sudden lack of work. In fact, it is unlawful for an employer to layoff or terminate an injured worker as retaliation for the filing of a worker's compensation claim. If this has happened to you, you may have the right to seek additional claims or penalties against your employer.
